Sycamore Park Fight With MRCA Mired In Lawsuits

Written by on February 5, 2019

The battle between the MRCA and residents in Sycamore Park has moved in to court rooms … as at least three lawsuits and counter lawsuits are in the works.

The MRCA —- the mountains resource conservation authority —- is attempting to seize a private road built by residents for use as a public park accessway without paying for it.

And without assuming legal responsibility for people who may get injured on the narrow route… which is essentially a series of driveways.

Assistant city attorney Trevor Rubin told the planning commission last night that’s all the trials have been put off at least a year or so.

NEWSCART 03642 TREVOR QQQQ ON THAT FROM THE COURT

“There (are) multiple lawsuits going on there, and there was supposed to be resolution in December about the access issues.

“And MRCA filed a cross complaint against neighborhood, which delayed the trial date and so you’re out maybe a year from resolution on that from the court.”

City planners say they have not received an application from the MRCA for a coastal development permit … which the city says is necessary if the MRCA wants to put a park in Malibu.
