LA Bans Many Overnight B and Bs – Malibu Considers Similar Rules

The city of Los Angeles yesterday took the first steps to ban overnight rentals of houses or apartments … unless it is the primary residence of the owner.

Malibu’s proposed overnight rental ordinance goes to the Malibu Planning Commission next week … and it does -not- have a similar feature.

Malibu’s proposed vacation house and party house would ban rentals in condo or apartment buildings … unless the owner is present on the property during the stay.

But Malibu houses would be allowed to be rented out … in their entirety … with no property manager on premises … or present even anywhere in Malibu city limits.

The present draft would require that the landlord actually lives at the property for a certain number of days a year.

City staff would gave to annually inspect the rentals for compliance with all fire safety and occupancy codes, …,

The proposed Malibu ordinance requires that all short-term rental property owners submit twenty-four hour contact information to the City…. and that neighbors be given notice and contact numbers as well.

Property contacts would be required to respond to complaint calls within one hour.

And if a house violates the city code … no more overnight rentals would be permitted there.

The matter goes to the Planning Commission next Monday … then to the city council later this spring.
