Overnight Rentals Are Illegal In Malibu

Written by on May 8, 2018

Malibu’s planning commission was asked last night to make recommendations on the cities proposed ordinance regulating overnight rentals … like B and B’s or beachfront short term rentals.

In the planning commissioners said … in essence … screw that … short term rentals are illegal under the current Malibu municipal code.

And that certainly upended the apple cart.

Last night’s vote was 3 to 1 … and it’s only a recommendation to the city council.

It came in after planning commissioners expressed real anger at city staff … for supposedly misrepresenting the comments of the planning commissioners in reports given to the city council.

More on that in a minute.

Last night … three hours of public speakers …

Some said they were long term residents of malibu who can’t afford to live here unless they rent out their units.

And they said that they were responsible hosts.

One Malibu landowner … Cesar Morea … said it was discriminatory to oppose overnight renters.

“I remember a long time ago, when people say ‘I don’t like to live with my neighbor because my neighbor’s is black or red or different.

“ `Or, I don’t like to live in a place where a person comes with a suitcase or no suitcase or whatever.’

“I think we have to be over that.”

But others said the issue is … that vacation rentals were driving locals out … increasing traffic  … and changing the fabric of the community.

Longtime resident Terry Lucoff said the elementary school population is dropping … students and their parents being displaced by overnight guests.

“So this isn’t about `gee I’m sure you’re all very nice people doing very nice rentals’ and you never have any trouble with any of your people.’

“That is not what this is about.

“This is about the future of Malibu what you want to see the future of Malibu look like.”

The planning commissioners sided with people like Beatrix Zeliskas … who quiet canyon above Paradise Cove has turned into a loud party house echo chamber.

“I hear people here, defending their income property.

“And I’m here to say, I  demand my rights: to live in a safe quiet peaceful enjoyment of my residence that is located in a residentially-zoned neighborhood. “

The recommendation to declare overnight rentals to be illegal in Malibu goes on to the city council.

And if the city council decides to legalize B and Bs … the planning commissioners say they have been working on this for half a year … and want to have input on the proposed changes.
