But Malibu community advisors say removing tons of dirt at the Malibu High School campus … dirt with tiny … barely detectable amounts of PCB in the soil … is worth it.

Allowing the Malibu Beach Inn to expand its parking lot across Pacific Coast Highway is unsafe and will cause a significant traffic jam on the coast highway.

That’s the conclusion of the Malibu city staff … in its long-awaited analysis of the hotel’s request to jump the PCH and put its parking lot on the inland side of the road.

A Malibu broadcasting company has filed what is in essence a lawsuit against the California Public Utilities Commission … for its plan to turn off electricity to Malibu when severe winds storms hit.

Zuma Beach FM Broadcasters Incorporated … operators of radio station KBUU … filed a legal appeal yesterday in San Francisco.

In news news from down the coast …

Scooter advocates were paid 5 dollars apiece yesterday by Lime … and a rapper was brought in to whip up the crowd for T-V cameras … as the scooter war boiled over in Santa Monica yesterday.

Lime and Bird that have flooded the westside with electric scooters …

And they are furious that the city of Santa Monica is on the verge of dumping them this fall.

A city council committee has decided that Bird and Lime violated the law … and have endangered public safety by flooding Santa Monica with scooters without requiring helmets … without training riders about state laws like staying off the sidewalk.

The selection committee endorsed scooter plans offered by Lyft and Jump … which is owned by Uber

Bird and Lime are furious.

They deactivated their scooters in Santa Monica yesterday …

Tat of course inadvertently gave  pedestrians a major safety break.

The L-A Times reports that the rally attracted a sizable crowd … with scores of people in black and green Bird and Lime shirts that were being doled out — for free — by employees.

11 large wildfires are still burning in California … and so far, the fires have burned some 740,000 acres and damaged or destroyed more than 2,000 structures.

More than 12,500 firefighters are working.

Closes to us … The Holy Fire near Lake Elsinore is 59 percent contained.

The Ortega Highway, a vital link between Lake Elsinore and Orange County that closed Aug. 7 because of the Holy fire, reopened to through traffic Tuesday morning.

In northern California … the Mendocino Complex fire blaze has burned 354,910 acres as of Tuesday night in Mendocino, Lake and Colusa counties.

The larger fire of the two up there is 64 percent contained … the smaller was fully contained.

Fire crews on the Mendocino Complex were mourning the loss of firefighter Matthew Burchett, age 42.

He was with the Draper City Utah Fire Department.

Burchett was the sixth firefighter to die battling wildfires in California this year.

Up near Redding … the Carr Fire has killed 8 people … it is 65 percent contained

And the Ferguson Fire near Yosemite is just about contained … nearby Yosemite Valley was reopened for the first time in weeks yesterday morning,

The Ninth U-S Circuit Court of Appeals yesterday issued a ruling … that guarantees that the the public has a right to photograph or record law enforcement officers working in public places.

Police in Los Angeles … and in Malibu … have repeatedly .. over past years … violated their own policies and prohibited TV  crews or news photographers and radio reporters from shooting pictures on public streets.

This does happen … sometimes … in Malibu.

KBUU was threatened with arrest by Ventura County sheriff’s deputy a year ago … on P C H  … in an area open to the general public.

The federal appeals court in San Francisco said yesterday that a U S government policy requiring advance permission from the Border Patrol to photograph their agents was unconstitutional.

The Ninth U.S. Circuit Court of Appeals said those broad justifications might not apply to constitutionally protected activities, like photography, in areas traditionally open to the public.
