A car crash on Malibu Canyon Road …inside the city of Malibu … has resulted in a lawsuit … against the city.

And that lawsuit had just gone to trial … a jury was picked … this week when the Coronavirus endemic hit.

The jury dismissed … a mistrial declared … and everything is on hold.

The lawsuit was filed by a woman who was hurt in 2015 … when the motorcycle she was a passenger on was hit by a car pulling out of Harbor Vista Drive … at the top of the hill above Malibu Ciivc Center.

Jury trials have been suspended. The plaintiff claims that a car being driven by Tia Jeri Hoberman pulled out in front of a motorcycle being driven by her friend.

The car made a left turn from Harbor Vista Drive onto Malibu Canyon Road. Hoberman allegedly failed to yield the right-of-way and her Audi SUV collided with the motorcycle …  which was traveling north on Malibu Canyon Road.

The driver of the car … the city of Malibu and Southern California Edison were all sued.

The motorcycle passenger maintains that the car driver’s vision was impaired by an improperly placed Edison power pole … and that the city negligently designed the curving intersection … at the crest of the hill.

the road was built by the county in the 1950s …

The city has long term plans to rebuild Malibu Canyon Road … to make it safer.
