City Releases Proposed Clampdown On B-And-Bs, Would Require On-Premise Hosts To Quiet Loud Parties

Malibu’s proposed ordinance on short term rentals … B-and-Bs … has been issued.
The planning commission will hold a Zoom meeting and vote on it in two weeks … on July 30th.
Beach rentals and party houses would be regulated.
The proposed changes to the zoning rules and local coastal plan is very similar to the B and B rules adopted in Santa Monica … which have been approved by both the Coastal Commission and the courts.
If adopted … Malibu would require all short-term rentals to have a host to live on the property.
Not necessarily the owner … but someone with authority to actively resolve any nuisance or compliance issues … and allow code enforcement officers to enter the property.
Only a primary residence could be rented out.
And unlike Santa Monica … in apartment or condo buildings … up to two units could be short term rentals.
This would prevent the conversion of multifamily units into unregistered hotels … the city says.
Michael Lustig … the Malibu Road resident who has become something of a national expert on short term rentals …. says the proposed ordinance still needs to be tightened up.
He says the B and B ordinance … if enforced .. will put Malibu be in the position to manage tourism … instead of reacting to it.
The Planning Commission will meet in 13 days … on the 29th … to consider the overnight rental ordinance.
Then it goes back to the City Council.
